remit profits, but the regulatory and documentation requirements are substantial. This guide sets out the real process.<\/p>\n    <a href=\"#contact\" class=\"btn-primary\">Get in Touch<\/a>\n  <\/div>\n<\/section>\n\n<!-- INTRO -->\n<section class=\"intro-strip\">\n  <div class=\"intro-inner\">\n    <h2>Brazil allows capital repatriation, but the process is regulated and documentation-intensive.<\/h2>\n    <div class=\"intro-col\">\n      <p>Foreign investors registered with the <a href=\"https:\/\/www.bcb.gov.br\/en\" target=\"_blank\" rel=\"noopener\" class=\"ref-link\">Central Bank of Brazil (Banco Central do Brasil, BACEN)<\/a> may remit profits, dividends and return of capital abroad. The legal framework is now governed by <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/l14286.htm\" target=\"_blank\" rel=\"noopener\" class=\"ref-link\">Law 14,286\/2021<\/a>, which entered into force on 1 January 2023 and replaced the prior regime built on <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l4131.htm\" target=\"_blank\" rel=\"noopener\" class=\"ref-link\">Law 4,131\/1962<\/a>. The implementing regulation is <a href=\"https:\/\/normativos.bcb.gov.br\/Votos\/BCB\/2022241\/Voto_do_BC_241_2022.pdf\" target=\"_blank\" rel=\"noopener\" class=\"ref-link\">BCB Resolution 277\/2022<\/a>, which came into force simultaneously. Registered foreign capital may be remitted abroad without restrictions on amount or frequency.<\/p>\n      <p>Return of original capital is permitted up to the registered amount. Profits and dividends may be remitted in full, provided the Brazilian entity's financial position is properly documented.<\/p>\n    <\/div>\n    <div class=\"intro-col\">\n      <p>In practice, most investors encounter several layers of procedural friction: the original investment must be formally registered with BACEN before any remittance is possible, each transaction must pass through an authorised exchange dealer, and supporting documentation (including audited accounts, board resolutions and registration certificates) is required for every remittance.<\/p>\n      <p>The process is legally permitted, but it is not simple, and it requires advance preparation.<\/p>\n    <\/div>\n  <\/div>\n<\/section>\n\n<!-- MYTH VS REALITY -->\n<section class=\"intro-strip\" style=\"background:#fff;\">\n  <div class=\"intro-inner\">\n    <h2>What \"freely repatriable\" actually means<\/h2>\n    <div class=\"intro-col\">\n      <p>Brazilian law does not impose capital controls that permanently block outward remittances. Registered foreign capital is described as \"freely repatriable\", meaning there is no statutory ceiling or government approval required to remit funds abroad, provided the procedural requirements under <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l4131.htm\" target=\"_blank\" rel=\"noopener\" class=\"ref-link\">Law 4,131\/1962<\/a> are met.<\/p>\n    <\/div>\n    <div class=\"intro-col\">\n      <p>What that phrase does not capture is the mandatory <a href=\"https:\/\/www.bcb.gov.br\/en\/financialstability\/registrationoforeigncapital\" target=\"_blank\" rel=\"noopener\" class=\"ref-link\">BACEN registration<\/a> requirement, the documentation obligations for each transaction, the required use of authorised exchange dealers, and the compliance review that precedes every remittance. \"Freely permitted\" describes legality, not simplicity.<\/p>\n    <\/div>\n  <\/div>\n<\/section>\n\n<!-- 2023 REFORM -->\n<section class=\"intro-strip\" style=\"background:var(--cream);\">\n  <div class=\"intro-inner\">\n    <h2>What changed in 2023: the new foreign exchange law<\/h2>\n    <div class=\"intro-col\">\n      <p><a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/l14286.htm\" target=\"_blank\" rel=\"noopener\" class=\"ref-link\">Law 14,286\/2021<\/a>, in force since 1 January 2023, substantially modernised Brazil's foreign exchange regime. The previous framework, assembled between the 1930s and 1960s in response to chronic balance-of-payments pressures, had become an obstacle to lawful cross-border business. The new law and its implementing regulation, <a href=\"https:\/\/normativos.bcb.gov.br\/Votos\/BCB\/2022241\/Voto_do_BC_241_2022.pdf\" target=\"_blank\" rel=\"noopener\" class=\"ref-link\">BCB Resolution 277\/2022<\/a>, brought three material changes relevant to foreign investors.<\/p>\n      <p><strong>Reduced bureaucracy.<\/strong> Authorised exchange dealers may now request or waive supporting documentation at their own discretion, based on their assessment of the client and the transaction. The previous regime required fixed documentation for every operation. The classification of transaction purpose, previously assigned by the dealer from a list of around 180 codes, is now the client's responsibility and uses a much shorter list.<\/p>\n    <\/div>\n    <div class=\"intro-col\">\n      <p><strong>Simplified reporting for smaller transactions.<\/strong> Foreign exchange transactions up to USD 50,000 (or equivalent) that do not need to be linked to a registered capital operation may be reported to BACEN in batch by the 5th business day of the following month, rather than on the same day as the transaction. These transactions also use a simplified set of 10 purpose codes rather than the full classification list. This covers the large majority of routine transactions by volume, though not by value.<\/p>\n      <p><strong>Non-resident bank accounts on equal footing.<\/strong> Authorised institutions may now open, maintain and close BRL deposit and payment accounts for non-residents under the same conditions as for residents. This is a significant practical change: non-resident companies and individuals (including foreign investors) can now hold and operate BRL accounts in Brazil without the additional requirements previously imposed. The requirements are cumulative: satisfying one does not remove the others.<\/p>\n    <div class=\"checklist-grid\">\n\n      <div class=\"checklist-item\">\n        <div class=\"ci-number\">01<\/div>\n        <div class=\"ci-content\">\n          <h4>BACEN registration of the original investment<\/h4>\n          <p>Foreign direct investment must be registered with <a href=\"https:\/\/www.bcb.gov.br\/en\/financialstability\/registrationoforeigncapital\" target=\"_blank\" rel=\"noopener\" class=\"ref-link-light\">BACEN via the RDE-IED module<\/a> (Registro Declarat\u00f3rio Eletr\u00f4nico) before any repatriation is possible. Repatriation is only permitted up to the registered amount. Unregistered capital cannot be formally remitted. Registration must be kept current: capital increases, ownership changes and partial disposals all require updates.<\/p>\n        <\/div>\n      <\/div>\n\n      <div class=\"checklist-item\">\n        <div class=\"ci-number\">02<\/div>\n        <div class=\"ci-content\">\n          <h4>Audited financial statements<\/h4>\n          <p>The Brazilian entity must have audited financial statements demonstrating the existence and amount of distributable profits (for dividend remittances) or confirming the capital position (for return of capital). Banks will not process the foreign exchange contract without these documents in order.<\/p>\n        <\/div>\n      <\/div>\n\n      <div class=\"checklist-item\">\n        <div class=\"ci-number\">03<\/div>\n        <div class=\"ci-content\">\n          <h4>Corporate approvals and board resolutions<\/h4>\n          <p>Dividend distributions require a formal resolution by the shareholders or board of directors of the Brazilian entity, in accordance with Brazilian corporate law. The resolution must specify the amount, the period to which the profits relate, and the intended recipient. This document is reviewed by the exchange dealer before the transaction proceeds.<\/p>\n        <\/div>\n      <\/div>\n\n      <div class=\"checklist-item\">\n        <div class=\"ci-number\">04<\/div>\n        <div class=\"ci-content\">\n          <h4>Authorised exchange dealer<\/h4>\n          <p>All outward foreign exchange transactions must be conducted through a financial institution <a href=\"https:\/\/www.bcb.gov.br\/en\/currencyandforeign\/exchangemarket\" target=\"_blank\" rel=\"noopener\" class=\"ref-link-light\">authorised by BACEN<\/a> to operate in the foreign exchange market. The dealer verifies documentation, executes the exchange contract and reports the transaction to BACEN. Funds cannot be remitted through informal channels or direct international wires that bypass the exchange contract requirement.<\/p>\n        <\/div>\n      <\/div>\n\n      <div class=\"checklist-item\">\n        <div class=\"ci-number\">05<\/div>\n        <div class=\"ci-content\">\n          <h4>Bank AML and compliance review<\/h4>\n          <p>Authorised exchange dealers apply their own anti-money laundering and compliance reviews independently of the legal requirements. Unusual transaction patterns, inconsistencies between the BACEN registration and the transaction amount, or gaps in supporting documentation will cause delays or block the remittance at the bank level, regardless of whether the transaction is legally permissible.<\/p>\n        <\/div>\n      <\/div>\n\n      <div class=\"checklist-item\">\n        <div class=\"ci-number\">06<\/div>\n        <div class=\"ci-content\">\n          <h4>Post-remittance BACEN update<\/h4>\n          <p>Following each remittance, the <a href=\"https:\/\/www.bcb.gov.br\/en\/financialstability\/registrationoforeigncapital\" target=\"_blank\" rel=\"noopener\" class=\"ref-link-light\">RDE-IED registration<\/a> must be updated to reflect the reduced foreign capital position. Failure to maintain accurate and current BACEN records creates compliance risk on all future transactions and may delay or block subsequent remittances.<\/p>\n        <\/div>\n      <\/div>\n\n    <\/div>\n    <div class=\"checklist-note\">The requirements are cumulative. A remittance that is legally permitted but lacks proper documentation will be blocked by the authorised dealer. Preparation must begin well before the intended remittance date.<\/div>\n  <\/div>\n<\/section>\n\n<!-- STEP BY STEP -->\n<section class=\"steps-section\">\n  <div class=\"steps-inner\">\n    <div class=\"section-label\">The Process<\/div>\n    <h2 class=\"section-title\">How a typical remittance works in practice<\/h2>\n    <div class=\"steps-list\">\n      <div class=\"step-item\">\n        <div class=\"step-num\">Step 1<\/div>\n        <div class=\"step-content\">\n          <h4>Verify BACEN registration<\/h4>\n          <p>Confirm the investment is registered in the <a href=\"https:\/\/www.bcb.gov.br\/en\/financialstability\/registrationoforeigncapital\" target=\"_blank\" rel=\"noopener\" class=\"ref-link\">RDE-IED system<\/a> and that the registered amount, currency and ownership structure correctly reflect the current position. Transactions with unlicensed foreign counterparties are capped at USD 100,000 per transfer.<\/p>\n      <\/div>\n\n      <div class=\"crypto-card\">\n        <h4>VASP licensing requirement<\/h4>\n        <p>Any entity providing virtual asset services in Brazil on a professional basis must be authorised by BACEN as an VASP. Foreign platforms wishing to serve Brazilian clients must either establish a licensed local subsidiary or partner with a licensed Brazilian VASP by 30 October 2026. Transactions routed through unlicensed platforms will be prohibited from that date.<\/p>\n      <\/div>\n\n      <div class=\"crypto-card\">\n        <h4>Self-hosted wallet identification<\/h4>\n        <p>Resolution 521\/2025 extends AML obligations to transfers involving self-hosted wallets. Where a transfer to or from a self-custodied wallet is intermediated by a licensed VASP, the provider must identify the wallet's owner and verify the origin and destination of the assets. This closes a significant reporting gap that previously existed for non-custodial arrangements.<\/p>\n      <\/div>\n\n      <div class=\"crypto-card\">\n        <h4>Receita Federal reporting obligations<\/h4>\n        <p>From 1 July 2026, the DeCripto electronic form replaces previous crypto reporting rules for the Receita Federal.
